General Terms and Conditions (GTC)

§ 1 Scope & Provider Identification

(1) The following General Terms and Conditions (GTC) apply exclusively to all orders placed via our online shop www.uygjewelry.com and are issued by:

Unless otherwise agreed, the inclusion of any terms and conditions used by you is hereby contradicted.

(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

(3) The version of the GTC valid at the time of the order shall apply.

(4) The prices valid at the time of the order shall apply. Promotional offers in our shop may be limited in time or quantity. Details can be found in the product description.

§ 2 Conclusion of Contract

(1) The subject matter of the contract is the sale of goods. Our online offers (jewelry, bags, and other products) are non-binding and do not represent a binding offer to conclude a contract.

(2) You can submit a binding purchase offer (order) via the online shopping cart system. By clicking the “Buy Now” button, you submit a binding offer to purchase the goods in the shopping cart. The automatic email confirming receipt of your order does not constitute acceptance of the contract.

(3) The contract is concluded only when we accept your order by sending a shipping confirmation email or by delivering the goods within five days.

§ 3 Individually Designed Products

(1) For products manufactured according to customer specifications or clearly tailored to personal needs (e.g., engravings, name necklaces, custom-made items, length adjustments), no right of withdrawal exists in accordance with § 312g para. 2 no. 1 BGB.

Exchange or return of individually designed products is generally excluded.

(2) The buyer agrees not to transmit any content or materials that violate third-party rights (e.g., trademark, copyright, or personal rights). UYG Trade GmbH assumes no liability for customer-provided content. You expressly indemnify us against all claims asserted by third parties in this context, including legal defense costs.

(3) We do not review submitted data for content accuracy and assume no liability for resulting errors.

§ 4 Data Protection

The collection and processing of personal data is carried out in accordance with our Privacy Policy. We use your data exclusively for contract fulfillment and, where legally permissible, for our own marketing purposes.

§ 5 Right of Withdrawal for Consumers

Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes primarily not related to their trade or profession.

(1) For non-personalized products, the consumer has a statutory 14-day right of withdrawal. Details can be found in our Withdrawal Policy.

(2) No right of withdrawal exists for individually manufactured products (§ 312g para. 2 no. 1 BGB).

§ 6 Delivery and Production Times

(1) Delivery is carried out by shipping service providers (e.g., Navlungo or ShipEntegre) to the address specified by the customer.

(2) Our production and delivery times (unless otherwise stated in the product description):

Ready-made products (in stock): shipped within 1–2 business days after payment.
Personalized products: production time approx. 3 business days; after completion, shipping with a delivery time of 4–9 business days.
Specially designed or custom-made products: production time 5–7 business days; shipping with a delivery time of 4–9 business days.

(3) All products are shipped from Turkey. Through the IOSS system (Import One Stop Shop), all import duties and taxes are already paid.

Customers within the EU do not incur additional fees or customs charges.
Orders placed on Saturdays, Sundays, or public holidays are processed on the next business day. Turkish public holidays also apply.

(4) In case of delivery delays, we will inform you immediately.
(5) If an item is not available, we reserve the right not to deliver. In this case, we will notify you immediately and refund any payments made.

(6) Shipping costs are shown separately during checkout (Germany: €5.99, EU countries: €7.99).

§ 7 Payment

(1) Payment can be made via:

(2) All payments are processed securely via encrypted connections. The purchase price is due immediately after conclusion of the contract. All prices include statutory VAT.

(3) The delivered goods remain the property of UYG Trade GmbH until full payment is received.

(4) You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.

(5) All prices include statutory VAT.

§ 8 Warranty

(1) Product images may differ from the appearance of the delivered products.

(2) Statutory warranty rights pursuant to §§ 434 ff. BGB apply. For defective or damaged goods, please contact us within 7 days via email. Each case will be reviewed individually, and repair, replacement, or refund may be offered.

(3) If goods are defective, we will provide supplementary performance within a reasonable period, either by repair or replacement. The place of performance is our business location. If the chosen method of supplementary performance is disproportionately costly, we may use the alternative. We bear the costs of supplementary performance. If the reasonable deadline expires without success, you may withdraw from the contract or reduce the purchase price.

(4) If you withdraw from the contract, both parties must return the received goods and any derived benefits. If the goods cannot be returned or are returned in a deteriorated condition, compensation for lost value may apply. Normal wear from intended use is excluded.

(5) Warranty claims expire 2 years after delivery of the goods.

§ 9 Liability

(1) Liability is limited to foreseeable, contract-typical damages. Further liability is excluded.

(2) All instructions on packaging and inserts must be observed. No liability is assumed for improper handling.

§ 10 Retention of Title

The goods remain the property of UYG Trade GmbH until full payment is received.

§ 11 Applicable Law, Place of Performance, Jurisdiction

(1) German law applies. The place of jurisdiction for all disputes with business customers is Munich.

(2) For consumers, the law of their residence country applies, provided mandatory consumer protection laws are relevant.

(3) The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

§ 12 Miscellaneous

(1) UYG Trade GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

(2) German law applies. The CISG is explicitly excluded.

3) Complaints must be submitted to the address provided in § 1.

§ 13 Final Provisions

If individual provisions of these GTC are wholly or partially invalid, the validity of the remaining provisions remains unaffected.
